New Boating Laws for Alabama

As of October 1, 2024, Alabama has implemented new boating regulations affecting non-resident boaters. Previously, non-residents aged 12 and older could operate vessels on Alabama waters for up to 45 days per calendar year without obtaining a vessel operator's license. Under the new law, non-residents are now required to have either:

1.A valid boater safety certification or vessel operator's certification issued in their home state.

2.A Nonresident Alabama Boater Safety Certification, obtainable under the same terms and conditions as Alabama residents.

This change aims to enhance safety on Alabama waterways by ensuring that all operators possess adequate boating knowledge and skills.

Additionally, a new law (HB358) that began enforcement on January 1, 2024, increased fines and other penalties for marine violations in Alabama waters.

Shoreline Structures and Modifications:

Alabama Power Company oversees shoreline management for Lake Wedowee and has established guidelines for structures and modifications:

•Piers: Should not exceed 50 feet in length, with a usable platform area up to 420 square feet. Walkways up to 4 feet wide are considered part of the length but not necessarily included in the square footage.

•Boathouses/Wet Slips/Boat Slips: Limited to 800 square feet, must remain open (not enclosed), though a portion of one exterior side may be walled for storage. Non- reflective materials are required, and habitable fixtures are prohibited.

•Boat Ramps: Should not exceed 20 feet in width and may only extend into the lake a reasonable distance from the shoreline, as determined by Alabama Power Company.

•Seawalls: Must be constructed as close to the existing shoreline as possible, with specific guidelines for backfill and materials. For detailed guidelines and permitting processes, refer to Alabama Power Company's shoreline management documents.


General Boating Regulations:

All boaters on Lake Wedowee must adhere to Alabama's general boating laws, which include:

•Age Restrictions: Operators must be at least 14 years old and possess a vessel license to operate a vessel or personal watercraft alone.

Prohibited Operations: Operating a vessel in a manner that creates a hazardous wake, operating above plane speed in restricted areas, and other reckless behaviors are prohibited.

•Boating Under the Influence: Operating a vessel with a blood alcohol concentration of 0.08% or more is illegal.
